Answers for specific cases, such as a company that is closing, a short chat history, records left in old systems or staff who have left.
- A data buyer contacted us. What should we do now?
Ask for the proposed scope, price and payment terms, describe the records you hold, and compare another offer before agreeing to a license.
- Can we include former employees' mailboxes?
Often, if they survived offboarding. Read them first, since they can hold personal and HR mail from people you can no longer ask.
- My company is closing. Can I sell our data?
Often, yes: SimpleClosure typically paid $10,000 to $100,000 per closing company, Forbes reported. A board, lender or bankruptcy court may need to approve.
- My partners or board need to approve. What do they need to see?
An inventory, a redacted sample, the offer's terms laid out and a list of what stays out. Your company agreement or bylaws decide whose approval counts.
- Our IT is outsourced. Who does the export?
Usually the IT firm, since it holds the admin roles an export needs. Your company is the customer, decides the scope and should keep a top admin account itself.
- Our records are spread across old systems we no longer use. Do they still count?
They can, if the records still exist in a form you can open: an export, an old server or backup drive, or a former vendor's copy before it is deleted.
- Our software vendor wants to use our data for AI. What does that mean for us?
Usually that its terms let it improve its own AI features with your data. Licensing records to an AI buyer is a separate deal you negotiate and are paid for.
- Some of our data is regulated. Can we still license the rest?
Often. HIPAA, GLBA, FERPA, the FCRA, CJIS rules and PCI DSS attach to particular records, so the systems holding them can stay out of scope.
- We acquired a company. Can we license its records?
Possibly. It turns on what the purchase agreement transferred, what the company promised people when it collected the data, and its own customers' contracts.
- We already cleaned up or deleted old data. Is anything left?
Often some of it. Deleted mail, files and tickets stay restorable for days or weeks, and holds, backups and others' copies can keep more.
- We have several companies or brands. How does that work?
Each company licenses the records it owns, and a brand belongs to the company behind it. Map systems to companies, then sign one agreement or several.
- We only keep 90 days of chat. Is our data still worth anything?
Often, yes. Provider thresholds count years in business or of records, and email, tickets and accounting are kept by default unless set to delete.
- We operate in the UK or EU as well as the US. Does that change things?
Yes, for the personal data your UK or EU operation holds. GDPR and UK GDPR set the tests for anonymization, new uses and transfers to a US buyer.
